1. Purpose

These Terms of Use (hereinafter "Terms") govern access to and use of the CoinCarriere platform, accessible at coincarriere.com, operated by 9558-9321 Quebec inc. (NEQ: 1181724304), with its head office in Quebec City, QC, Canada.

By accessing the Platform or using its services, you agree to be bound by these Terms. If you do not accept these terms, please do not use the Platform.

2. Definitions

  • Platform: the website coincarriere.com and all associated services
  • User: any person accessing the Platform, whether registered or not
  • Candidate: any registered User using the Platform to search for employment, submit a resume, or apply to job postings
  • Employer: any legal or natural person using the Platform to publish job postings and manage recruitment processes
  • Recruiter: any user acting on behalf of an Employer on the Platform
  • Content: any text, image, file, resume, job posting, or other information published on the Platform
  • Services: all functionalities offered by the Platform (job posting, resume submission, application management, interview scheduling, etc.)

3. Registration and User Account

3.1 Account Creation

Access to certain Services requires creating an account. When registering, you agree to:

  • Provide accurate, complete, and up-to-date information
  • Maintain the confidentiality of your login credentials
  • Immediately inform us of any unauthorized use of your account
  • Not create multiple accounts for the same person

3.2 Minimum Age

You must be at least 16 years old to use the Platform. By creating an account, you confirm that you meet this requirement.

3.3 Account Responsibility

You are solely responsible for all activities carried out under your account. CoinCarriere shall not be held liable for any damage resulting from unauthorized use of your account.

4. Services Offered

4.1 For Candidates

  • Browse published job postings
  • Submit resumes and create a professional profile
  • Apply online to job postings
  • Track application progress
  • View scheduled interviews
  • Receive application-related notifications

4.2 For Employers and Recruiters

  • Publish and manage job postings
  • Receive and manage applications
  • View Candidate resumes and profiles
  • Schedule and manage interviews
  • Evaluate Candidates and manage the recruitment pipeline
  • Manage job offers
  • Analytics and reporting tools

4.3 Availability

CoinCarriere strives to ensure Platform availability 24/7. However, we do not guarantee uninterrupted access and reserve the right to temporarily suspend access for maintenance, updates, or in cases of force majeure.

5. User Obligations

5.1 General Obligations

By using the Platform, you agree to:

  • Comply with applicable laws and regulations
  • Not publish unlawful, defamatory, discriminatory, hateful content or content that infringes the rights of third parties
  • Not impersonate another person or entity
  • Not use the Platform for fraudulent or malicious purposes
  • Not attempt to gain unauthorized access to Platform systems or data
  • Not use bots, scrapers, or any other automated means to collect Platform data
  • Not disrupt the operation of the Platform

5.2 Candidate-Specific Obligations

  • Provide truthful information in their resume and profile
  • Not apply to job postings in an abusive or irrelevant manner
  • Respect the confidentiality of information related to recruitment processes

5.3 Employer-Specific Obligations

  • Publish genuine, lawful, and non-discriminatory job postings
  • Comply with applicable labor legislation
  • Process Candidate data in accordance with personal information protection laws
  • Not use Candidate resumes and information for purposes other than recruitment
  • Not publish misleading postings, disguised marketing, or pyramid schemes

6. User-Published Content

6.1 Content Ownership

You retain intellectual property rights over the Content you publish on the Platform (resumes, job descriptions, etc.). By publishing Content, you grant CoinCarriere a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such Content for the purpose of operating the Services.

6.2 Content Liability

You are solely responsible for the Content you publish. CoinCarriere does not systematically verify Content published by Users and shall not be held liable for its accuracy or legality.

6.3 Moderation

CoinCarriere reserves the right to remove any Content that violates these Terms, applicable laws, or that is reported as inappropriate, without prior notice or compensation.

7. Intellectual Property

All elements of the Platform (design, logos, texts, source code, databases, features) are the exclusive property of 9558-9321 Quebec inc. or its licensors and are protected by intellectual property laws.

Any unauthorized reproduction, representation, modification, or exploitation of all or part of these elements is strictly prohibited.

The name "CoinCarriere," the logo, and associated trademarks are trademarks of 9558-9321 Quebec inc. Their use without prior written authorization is prohibited.

8. Limitation of Liability

8.1 Intermediary Role

CoinCarriere acts as a technical intermediary between Candidates and Employers. As such:

  • We are not party to employment relationships between Candidates and Employers
  • We do not guarantee employment for Candidates
  • We do not guarantee the quality of Candidates for Employers
  • We are not responsible for hiring or rejection decisions

8.2 Disclaimer of Warranties

The Platform is provided "as is" and "as available." To the fullest extent permitted by law, CoinCarriere disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.3 Liability Cap

To the fullest extent permitted by applicable law, CoinCarriere's total liability for any damage related to use of the Platform is limited to the amount of fees you have paid us during the twelve (12) months preceding the damage, or one hundred Canadian dollars (CAD $100) if no fees have been paid.

9. Suspension and Termination

9.1 By the User

You may stop using the Platform at any time and request deletion of your account by contacting us at contact@coincarriere.com.

9.2 By CoinCarriere

We reserve the right to suspend or terminate your access to the Platform, without notice, in the event of:

  • Violation of these Terms
  • Fraudulent or abusive behavior
  • Publication of unlawful or inappropriate content
  • Unauthorized use of the Platform (scraping, spamming, etc.)
  • Interference with the security or operation of the Platform

10. Personal Information Protection

The collection and processing of your personal information is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Platform, you acknowledge having read this policy.

11. Third-Party Links

The Platform may contain links to third-party websites. These links are provided for informational purposes only. CoinCarriere exercises no control over these sites and is not responsible for their content, privacy practices, or availability.

12. Modifications to Terms

CoinCarriere reserves the right to modify these Terms at any time. In the event of a substantial modification, we will inform you via a notice on the Platform or by email. Continued use of the Platform after notification constitutes acceptance of the modified Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada. Any dispute relating to the interpretation or performance of these Terms shall be submitted to the exclusive jurisdiction of the courts of the judicial district of Quebec, Quebec City, Canada.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.

15. Waiver

CoinCarriere's failure to exercise a right provided under these Terms shall not constitute a waiver of that right.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CoinCarriere regarding the use of the Platform.
